Why Should I Hire A Lawyer?
Abraham Lincoln once said, “He who represents himself has a fool for a client.” But not every case requires a lawyer, and that’s okay. Some legal matters can and should be handled yourself. It usually doesn’t make sense to hire a lawyer to handle a trip to municipal court to pay parking tickets, or to prosecute a legal matter where the costs of a lawyer would be greater than the financial recovery you are seeking.
But most legal matters are more complicated than paying a ticket, and when there is a lot at stake – such as your health or your career – you are at a serious disadvantage without an experienced counsel on your side. Without sound legal advice and guidance, you could make serious mistakes that could adversely impact your rights and limit your ability to receive full compensation for your harms and losses.
Here are several reasons you should consider hiring a lawyer to handle your legal matter:
Better outcomes – While lawyers are ethically prohibited from guaranteeing any particular outcome in a case, several studies suggest that hiring a lawyer can have a dramatic effect on case outcomes. For example, a study conducted by the Insurance Research Council found that in 85% of personal injury cases insurance companies decided to settle, the person was represented by a lawyer. On average, those people who were represented by a lawyer received a settlement that was 3.5 times larger than those who were not represented. The takeaway from this study is that you are much more likely to receive a settlement offer from an insurance company if you have a lawyer, and the settlement offer is likely to be significantly more, even after paying a customer contingency fee, than you would be able to obtain on your own.
Case assessment – Many lawyers, including the Law Office of Kevin A. Jones, will offer a free consultation to determine whether your case has legal merit. An experienced lawyer can also give you an assessment of the potential value of your case. This will help you decide whether it is worth your time and energy to pursue legal action.
Complicated laws – Very few Missouri laws are cut and dry. Many cases may involve several different but interrelated laws, and the outcome of your case can depend on which law is utilized in your case. Determining which law best fits your case can require complicated analysis of statutes, regulations, and decades of existing caselaw. Lawyers are trained to conduct this type of legal analysis and are required to attending continuing education programs every year to stay on top of recent developments in the law.
Because the law is wide-ranging and sometimes unnecessarily complex, most attorneys choose to focus their practices in just a few areas of law so they can develop a deeper expertise than if they tried to be a “jack of all trades.” Lawyers truly dedicated to their profession will have spent thousands of hours studying the law so they can better serve their clients. At the Law Office of Kevin A. Jones, we are committed to maintaining a mastery of personal injury and employment law.
Having the best case in the world doesn’t mean anything if you don’t know how to use the law. Hiring an experienced lawyer with appropriate expertise will save you the considerable trouble of having to figure out the law on your own, and will help you avoid legal pitfalls that can destroy your case.
Intimidating process – Making a legal claim can seem scary and daunting. And the process often differs depending on the type of case you have. Some cases require that you file your case with a government agency, while others allow you to proceed directly with a lawsuit in court. In either case, there are strict deadlines and rules that must be followed. If you miss a deadline or fail to follow a rule, your case could be over. With an experienced lawyer who has successfully navigated the legal process many times, you can be confident that your case will move efficiently and effectively through the process, giving you the best chance at a successful outcome.
Costs – Pursuing legal action can be expensive. In personal injury and employment cases, there are often filing fees, court reporters, mediators, expert witnesses, and other expenses that will need to be paid to move your case through the legal process. In complex cases, these expenses can easily reach into the tens of thousands of dollars. Personal injury and employment lawyers who represent ordinary people, not multinational corporations and insurance companies, understand that their clients often do not have the financial means to shoulder the costs of pursuing a legal claim.
Most law firms, including the Law Office of Kevin A. Jones, will advance these costs on behalf of the client and later deduct them from any settlement. We believe law firms should be transparent about these costs and we discuss them with our clients before we begin our representation. Before you accept a settlement offer, we will give you an itemization of all costs incurred, so you will know exactly how much of the settlement will go into your pocket. We find that transparency is the key to helping clients make the best decisions about their legal case.
Level the playing field –When you make a legal claim, you begin an adversarial process where your interests are necessarily pitted against someone else’s. And when the other side is a large corporation or insurance company, you can be sure they will try to use their size and power to bully you into giving up or taking a meager settlement offer. They will not take you seriously because they know how difficult it is to navigate the legal process without a lawyer. With an experienced lawyer on your side, you will see a sudden shift in the way the other side views your case. They will realize you are a much larger “threat” with an advocate who knows how to utilize the justice system to get you the best possible result.
Expert negotiators – Insurance companies employ skilled negotiators, called “adjusters,” try to convince you that your case isn’t worth anything so the insurance company doesn’t have to pay what it owes. Personal injury lawyers work with insurance companies every day and know how to deal with their high-pressure negotiating tactics. With an attorney giving you objective advice about the value of your claim and dealing with the insurance company on your behalf, you won’t feel pressured to settle your case for less than what it is worth.
Peace of mind – If you suffered a serious injury or a major career setback, you have a lot on your plate. Your focus should be on recovering from your injury, or getting your career back on track. You probably don’t have the time or energy to deal with insurance companies or lawsuits, but you also don’t want to let what happened to you go without standing up for what is right. Hiring an attorney can help you do both. An attorney will promptly investigate your case, run down important records and witnesses, handle all the necessary paperwork, negotiate with the other side, and make sure your interests are protected at all times. In short, hiring an attorney will give you the peace of mind that your legal claim is being professionally handled while you focus on the things most important to you.
Why Choose Us
There are a lot of “high volume” law firms that have hundreds of cases assigned to each attorney. It is impossible for one attorney to give meaningful attention to that many cases, so the cases are typically handled primarily by non-lawyer administrative staff. This can result in miscommunication, difficulty getting questions answered, and balls getting dropped.
That’s not how we do things at our law firm. When you hire Kevin, you get Kevin. Not a paralegal, case manager, or a lawyer fresh out of law school. Our firm limits the number of cases we take so Kevin can devote his full attention to his clients’ important legal matters. He enjoys getting to know his clients on a personal level and staying in touch with them long after their case concludes. While he finds that strong relationships make the practice of law more enjoyable, they also help him understand his clients’ needs and desires so he can effectively advocate for his clients.
We are committed to making sure you understand the process and are well-informed throughout your case. This begins with our initial consultation, where we will give you an honest and straightforward evaluation of your claims. We will explain your legal options and outline next steps for moving forward. We give estimates on case values and time frames, so you know what to expect. We update you when we receive new information about your case. And we are available to answer any of your questions by phone, videoconference, or email.
Our founding attorney, Kevin Jones, has obtained tens of millions of dollars in settlements and verdicts for his clients. He is well-respected by defense lawyers and judges alike, and has leveraged his reputation to obtain excellent outcomes for his clients in contentious negotiations and litigation.
In his first decade of being a lawyer, Kevin has obtained more courtroom experience than many attorneys have in their entire careers. He has successfully tried cases before judges and juries, and has argued cases at all levels of Missouri courts, including the Missouri Supreme Court.
Hiring Our Firm
As a small law firm, we limit the number of cases we take to those where believe we can make a meaningful impact in our clients’ lives. By limiting our practice to serving a smaller number of clients, we can offer more personalized service and a better legal experience than many large, high-volume law firms.
Most people who come to us for help have experienced a serious injury or major career setback, resulting in a loss of income and an ever-growing stack of bills to pay. Many of these folks have no idea how they are going to make ends meet, much less pay a lawyer.
That’s why we accept cases primarily on what’s known as a “contingent fee” basis, meaning our fee is “contingent” on our ability to get you a successful outcome. That means you don’t pay us any fees upfront, and if we don’t win your case, you don’t pay us any attorneys’ fees at all.
Contingency fees can be calculated as either a percentage of the financial recovery or by the amount of time the attorney spends on the case. Many law firms charge contingency fees ranging from 40-50% of the settlement. Because we are a smaller law firm with less overhead, we typically charge 33-45%, depending on the type of case and how long it takes to resolve.
If you think those are large percentages, you are right. But the old adage rings true, you get what you pay for. As noted above, studies show that people with lawyers on their side are far more likely to get a settlement offer from insurance companies, and the settlement offer is, on average, 3.5 times larger than what people can get on their own. We have handled cases where we have been able to increase the settlement offers to our clients by far more than that.
In one recent case, our client came to us with an offer of only a few thousand dollars. After growing frustrated with not being taken seriously, he hired Kevin and was ultimately paid 95 times more than what he was initially offered.
Before you hire us as your lawyer, we will provide you with a copy of our attorney-client agreement and we will review the provisions with you in person to make sure you understand what you are signing.
If you are contemplating legal action for a personal injury or employment-related matter, we would be honored if you would consider our firm to represent you. Please contact our office to speak with a Kansas City personal injury and employment lawyer today.
